CONTRACT OF SALE
ROVITALY S.r.l. accepts orders with delivery to be made exclusively within Italian and European territory.Once the purchase procedure has been completed and the goods have been dispatched, ROVITALY S.r.l. shall issue an invoice, which shall be sent by e-mail to the holder of the order, pursuant to art. 14 of Presidential Decree 445/00 and Legislative Decree 52/2004 and any other relevant regulations.
ROVITALY S.r.l. shall only include in the aforementioned invoice the data provided by the customer at the time of the order, specifying that no variation shall be allowed after the invoice has been issued.
The client may only purchase the products, as per the electronic catalogue on the website www.rovitaly.it existing at the time the order is sent. In this regard, ROVITALY S.r.l. informs the customer that the images and technical data, none excluded and/or excepted, accompanying the product information sheet displayed must not be considered by the customer as complete and exhaustive of the characteristics, but may, therefore, be different in terms of size, colour and accessories or other.
The customer declares that he/she is aware that the wording "available" of the product displayed is merely indicative, when considering the concrete possibility of multiple purchases that may occur simultaneously by several users and/or customers. It follows that ROVITALY S.r.l. reserves the right, once the order has been received, to verify the actual availability of any goods ordered and, failing this, to promptly notify the non-acceptance of the order sent, for the reason stated above.
For everything communicated and accepted by the customer up to this point, ROVITALY S.r.l. shall not be held liable for any reason or title whatsoever.
Correct receipt of the order shall be confirmed by ROVITALY S.r.l. through an email reply sent exclusively to the email address provided by the customer. This confirmation message will re-propose all the data entered by the customer, who undertakes to verify its correctness and to communicate, within and no later than 2 days, any corrections to the data. Subsequent days, any corrections. Only after ROVITALY S.r.l. has verified the actual availability of the goods, as well as the correctness of the customer's data, will it send an e-mail confirming final acceptance of the contract, which from this moment onwards shall be considered concluded and stipulated between the parties for all legal purposes.
By placing an order on the website rovitaly.it the customer declares to have read the conditions of sale, the payment terms proposed and the entire purchase process and also declares to accept them without reservation and to have received full information about it. Furthermore, with express reference to Articles 3 and 4 of Legislative Decree 185/89, the customer will receive, via e-mail, all the information necessary for the identification of the seller, which the customer is obliged to keep together with the e-mail of acceptance of the contract.
In the event that the client should return, for legitimate reasons, the purchased products, he/she must provide for the shipment within the established terms and exclusively to the headquarters of ROVITALY S.r.l. - Viale Michelangelo, 71 - 80129 Napoli.
INVOICE
The Invoice is inserted at the time of shipment inside a transparent envelope which is attached to the outside of the package. The customer may, however, request a copy by filling in the online form.The Invoice must be kept with care, as it is the valid document for the product warranty.
ORDER PROCESSING
ROVITALY S.r.l., in order to guarantee a correct service to its customers, guarantees the receipt and acceptance of purchase orders up to 3.00 p.m. from Monday to Friday; orders received after that time, as well as those received on Saturdays, Sundays or other holidays, shall be considered received on the first working day following the day the order was placed.Any reductions in working hours and/or interruptions in sales services in particular periods of the year (e.g. summer months) that could result in longer delivery times shall be adequately highlighted at the time the order is placed, and it shall be at the Customer's discretion whether or not to confirm the order according to the times indicated.
At the time of delivery of the goods, the Customer is required to check
- that the number of packages delivered corresponds to that indicated in the transport document
- that the packaging is intact and not altered, including the closing tapes.
In case of tampering and/or breakage, the Customer must immediately dispute the shipment and/or delivery by writing "RESERVE FOR DAMAGED PACKAGE" on the copy of the delivery document to be returned signed to the courier or other operator.
The Customer is required to report any damage within 7 (seven) days from receipt of the goods, by registered mail in advance or by e-mail, the following references:

For each delivery order, the Client is required to specify at least one telephone number to allow the express courier to contact him in the event of delivery difficulties; should the delivery fail due to causes not attributable to ROVITALY S.r.l. or the express courier for more than 5 consecutive days, the order shall be considered cancelled and the Client shall be charged with the costs of storage as quantified by the express courier.
SHIPMENTS AND DELIVERIES
The back office processes orders received by 3 p.m.; otherwise they are processed the following day. The same applies to orders received on a Saturday, Sunday or public holiday: they will be processed on the first working day following the day the order was placed.
If the goods are available, the order is processed depending on the method of payment chosen, and in particular
- if the method of payment chosen is CREDIT CARD, PAYPAL, COD, the order will be processed the same day;
- if the payment method chosen is BANK TRANSFER, the order will be processed when the incoming flow of the order amount is displayed on the accounts of ROVITALY S.r.l..
On the day following the order, the courier shall collect the goods from our warehouses by 6 p.m. and the day after collection, it shall assign the shipment tracking number and set the goods in motion. Our back office enters the Tracking number in the customer's private area, allowing the customer to follow the delivery status and estimated delivery times in real time on the Courier Forwarder's website.
The product will be delivered to the address indicated when the order is confirmed, and the cost of transport is calculated according to the volume and weight of the items ordered.
Product delivery times vary depending on the item ordered by the Customer (e.g. whether the item is available) and the delivery method chosen by the Customer. The times indicated for delivery terms are merely indicative and are in no way binding for ROVITALY S.r.l.
If express courier services are used, delivery is expected to take between 10 and 15 working days from the moment the order is placed.
Methods of Delivery
1) Standard Delivery:
delivery takes place within 3-4 working days from the date of assignment to the Courier.
In detail: We deliver in 48 hours from the time we entrust the courier with the goods. For Sardinia, Sicily and the smaller islands a surcharge will be applied to the shipping cost.
In addition, the above-described timeframe for the islands may vary depending on unforeseeable elements: for example, adverse weather conditions, etc.
2) Insured shipping
In detail: This option allows you to insure the total amount of your order. Please note that in order to activate the insurance, you must accept the package subject to a specific control in order to be certain that no damage has been caused after delivery.
3) Delivery by appointment
In detail: This option allows you to be contacted by the courier at the telephone number you specify in your order in order to arrange the most convenient day and time for delivery.
4) Delivery to the floor
In detail: This option allows you to receive the products you have ordered on the floor of your choice.
Transport cost:
The cost of transport is determined by the Courier and is a function of the weight and/or volume of the package(s) purchased by the customer. As described above, there are additional (extra) services such as insured shipping, delivery by appointment and delivery to the floor.
Our "Shopping Cart" automatically recalculates the total amount of your order every time you add or delete an extra option.

Refunds
Any refunds shall be made by ROVITALY S.r.l. in the following ways
by bank transfer if the customer has paid by bank transfer and/or cash on delivery, by credit card if the customer has paid by credit card, and by PayPal if the customer has paid by PayPal.
The refund will be made within and no later than 10 working days.

EXTRACT FROM LEGISLATIVE DECREE 22/5/1999 n. 185 ON CONTRACTS CONCLUDED AT A DISTANCE "Commercial relations of sale are regulated by these conditions of sale as per current Italian legislation. The Supplier shall make shipments to the Customer with selected express couriers and the goods shall travel carriage paid, with the costs and risks of transport borne entirely by the Customer. These costs and any other charges connected with the transport and/or shipment of the products are calculated and detailed in the order confirmation and purchase invoice. Upon receipt of the goods at their home address, the Customer must check the integrity of the packages. In the event of discrepancies and/or differences, the Customer shall be responsible for refusing the goods".
PAYMENT METHODS
Credit Cards Visa Mastercard Circuit
In case of purchase of goods with credit card payment method, at the conclusion of the online transaction, the bank of reference will authorize only the amount of the purchase.
The credit cards accepted are all those that use the Visa, Mastercard, Maestro and PostePay circuits, which is to all intents and purposes a Visa credit card.
In case of cancellation of the order, either by the customer or in case of non-acceptance of rovitaly.it, the same contextually require the cancellation of the transaction and the release of the amount committed. The cancellation of the order is possible until the same is not yet in stock. The order status is clearly visible in the "Order Status" area and can no longer be cancelled if the indication "Order shipped" appears. Release times for some types of cards depend exclusively on the banking system and can be up to their natural expiry date (24 days from the date of authorisation). Requested the cancellation of the transaction, in no event rovitaly.it can be held liable for any damages, direct or indirect, caused by delay in the failure to release the amount committed by the banking system.
Bank transfer
The bank transfer does not foresee any additional cost.
By choosing this method, the user will receive in the order summary email the details to make the payment. The shipment, in this case, will start as soon as the amount will be credited to our account; at that time the user will be informed of the crediting through an email on which will be notified the change of the order status that will pass to Order in progress.

Cash on delivery
Payment by cash on delivery allows you to pay the product to the courier upon delivery.
For amounts over € 1,000, a bank draft payable to the courier is required. On the other hand, for cash payments, in order to make delivery faster and more efficient, we recommend that you prepare the exact amount to be handed over to the courier, as he often does not have a cash box and is therefore unable to give change.
PayPal
By choosing PayPal as payment method, the user will be redirected safely to PAYPAL's secure server, where he can pay with the main enabled credit cards (e.g. VISA, MASTERCARD), or with POSTEPAY or other enabled rechargeable prepaid cards.
*NB: If you choose this method of payment, it is essential that the shipping address registered in the website account is the same as the one in your PAYPAL account, otherwise the order will be cancelled and payment will be refused.
RIGHT OF WITHDRAWAL
ROVITALY S.r.l. acknowledges the right of withdrawal:
Pursuant to Legislative Decree no. 206/2005, if the customer is a consumer (i.e. a natural person who purchases goods for purposes that do not relate to his/her own professional activity, or does not make the purchase by indicating a VAT number on the order form to rovitaly.it), he/she is entitled to withdraw from the purchase contract for any reason whatsoever, without the need to provide explanations and without any penalty.
The product must be returned in respect of resale (undamaged, never used and complete with the original packaging).
The Customer must give notice within 14 days from the date of delivery of the goods by registered letter with return receipt in advance, by fax or by using the appropriate on-line form, the references of which are given below:

Upon receipt of the registered letter, we will provide the exact return address of the product.
Goods returned without authorisation will be automatically rejected.
In addition to the intention to exercise the right of withdrawal, it is essential to indicate in the same communication the details of a bank account or postal account to make the re-credit of the amount due (CIN Code, ABI Code, CAB Code, Account Number, Account holder). For the correct recognition of the right of withdrawal, we specify that:
- The product must be returned by the Customer in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment, intact consumables, manuals, cables, etc. ...); to limit damage to the original packaging, we recommend, when possible, to put it in a second box; it should be avoided in all cases the attachment of labels or adhesive tapes directly on the original product packaging;
- The product must be returned within the time and in the manner described above to the address that will be indicated by ROVITALY S.r.l.
- The costs of redelivery shall always be borne by the Client.
ROVITALY S.r.l. reserves the right to inspect the returned goods in order to assess any damage or tampering that is not due to transport.
The refund shall concern all sums paid for the price of the product, with the exclusion of transport costs and any bank charges incurred by the Client, and shall be made no later than 14 days from receipt of the registered letter of withdrawal, exclusively by bank transfer. In the event that the user opts to replace the product, the cost of sending the new product shall be borne by the user.
Any customised products, as provided for by Legislative Decree 206/2005, cannot benefit from the right of withdrawal.
PRODUCT WARRANTIES
The products are directly guaranteed by ROVITALY S.r.l. for 12 months from the date of the invoice for conformity defects, pursuant to Legislative Decree 24/2002. In order to benefit from the assistance under warranty, the Client shall keep the invoice (or the transport document) which he will receive by e-mail in PDF format.
The manufacturer's conventional warranty is provided in accordance with the procedures illustrated in the documentation inside the product packaging. Please note that the private consumer (a person who buys goods for purposes not related to his professional activity, or making a purchase without indicating in the order form a reference to VAT) is reserved for the guarantee of 24 months.
If, following the intervention of an Authorised Service Centre, the defect should not be covered by the manufacturer's conventional warranty, the Customer will be charged for any verification and repair costs required by the Authorised Service Centre, as well as transport costs, if incurred by ROVITALY S.r.l.
In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Client in their original packaging, complete in all their parts (including packaging and any documentation and accessory equipment, intact consumables, manuals, cables, etc.); in order to limit damage to the original packaging, we recommend, when possible, to put it in a second box; in all cases, the affixing of labels or adhesive tapes directly onto the original product packaging must be avoided.
All shipments of products that do not include packaging, accessories and accessories will be returned to the Sender at the Sender's expense:
- Not including original packaging, accessories and manuals;
- Received with unsuitable or inadequate outer packaging and therefore damaged during transport: the Warranty does not cover damage due to failure to use the original packaging and adequate protective outer security packaging not authorised by the service centre.
The Warranty does not cover any damage due to the non-use of original packaging and adequate external protective safety packaging not authorised by the assistance centre. ROVITALY S.r.l. shall not be responsible for the loss of data on the product being serviced.
Any right of the Client to compensation for damages or indemnities, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things shall be excluded.
TRANSPORT INSURANCE
Upon receipt of your package, you should check that the carrier's packaging is intact and not cut and/or tampered with. If this is not the case, it is likely that the package has been opened during shipment and that the contents have been stolen.
If you accept a tampered package, and if you did not choose insurance at the time of purchase, there is no possibility of making a claim.
We therefore recommend that you check the integrity of the package before accepting it.
In the event of suspected tampering or a missing parcel, you may accept the goods subject to a specific reservation (indicate the reason). We would like to inform you that in accordance with Legislative Decree 22/5/1999 no. 185, goods travel at the risk of the addressee, so if the goods are not insured, the back office processes orders received by 12 AM; otherwise they are processed the following day.
